Development from previous post about Frolic Mills’ trademark infringement with Miss [SL] Universe.

I didn’t realize that writing a blog post about a current event in Second Life would get me any negative attention. Nor, did I realize that Freedom of Speech is a punishable right.

As mentioned in my previous post, Linden Labs is cracking down on the use of Miss Universe and Miss SL Universe throughout Second Life, due to the fact that evidently, Donald Trump isn’t too happy about his trademark being infringed upon by Frolic Mills of Best of SL Boulevard and the pageant. As a described also in the last blog post, according to law, Frolic Mills has violated the law by committing trademark infringement and potentially trademark dilution when attempting to take the trademarked Miss [SL] Universe as his own. Why else would Linden Labs be taking action, if he weren’t in violation? Answer: They wouldn’t.

I have been a member of the Best of SL Magazine Readers group for a time now, basically using it to gauge trends and see what is being sold where and get a feel for what people are interested in. I rarely spoke in the group, aside of asking which stores for ladies have gift cards/certificates and recommending a pair of sneakers once, I think. I posted in my blog about it yesterday and today, guess what happened? I was ejected without explanation from the group, which is run by Frolic Mills. I messaged him, inquiring as to why I was ejected from the group without provocation. No reply. I asked two more times. No reply. In the post that I wrote, if you have read it, I was both impartial and viewing it from a journalistic point-of-view. At no point did I incite a riot or a lynch mob out for Frolic Mills’ blood. No, I was as objective as one person could possibly be when one individual’s actions could possibly affect the Second Life experiences of every single user on the grid. Yet, without a word, I was ejected from the group and refused a reason.

When not towing the party line or speaking one’s mind as a writer/journalist (with AP affiliations, I might add), is it the norm to be frozen out or greeted with ignorance? If I had been biased in the posting in Frolic’s favor, would I have not been ejected from the group? Gee, perhaps I would have even received my very own ticker tape parade down Best of SL Boulevard. I find it amusing that so many people claim to want to be individuals, make good use of their own Freedom of Speech and pass judgment on others for their actions, but when an outside party speaks their mind with tact and objectivity (note: in the previous post, I even stated that I was unsure if he was guilty of trademark dilution), they are ejected from a group that claims:

THE BEST OF SL Magazine is a monthly publication which celebrates and honors those who have excelled in ANY field in Second Life.

Btw, this is a chat group, and boy do we ever chat ! So if you don’t like to communicate this is not the group for you.

Best regards,

Frolic Mills – Chief Editor

Is there fine print left out that explains that all of the above is fine and good, as long as you agree emphatically with everything that Frolic Mills says and does? If so, I missed that part and I think quite a few other people did, too. I wrote an impartial piece that focused more on the rammifications of the situation of Frolic Mills’ committing trademark infringement and casting a negative light on Second Life as a whole, but apparently, I struck a nerve. Personal word of advice to Frolic Mills: If you can’t do the time, don’t do the crime.

  1. Well, if you followed the hoohaas over BabyHoney Bailey resigning from her Miss title, you’d have known that Frolic is a very sensitive person 🙂 But if one just assumes that professionalism has nothing to do with the way Frolic’s empire is run, then his response isn’t so surprising, I suppose

  2. I am physically sitting right beside Babyhoney Bailey right now, so I know for a fact that whoever left that comment was NOT the actual Babyhoney Bailey and really, they don’t even sound like her. Secondly, I am without net at the moment and the blog is set for comments to be approved.

  3. Aside from this being really ridiculous, and my wanting to stay as far away from posts of this nature (meaning the topic at hand) – I just wanted to reiterate the fact that whoever you are mask wearing not-so-anonymous – though I appreciate your meek attempt at supporting and promoting Crush Row – you don’t sound anything like me.

I type how I speak, have a mad love affair with commas and hyphens – and thanks to my Mama’s most awesome and superb upbringing do not use words like “retarded” ever. Though, nice try there. If you’d like to continue being anonymous – I’m sure we could come up with a much cooler alias. Something like FlyingEagle or Bigbadwold20921!!11 – both names of which would sound much more fantastic on a CB radio, cause let’s be honest Babyhoney totally sounds like a stripper. ❤ Strippers.

Anyway, nothing more to see here, back to your regular scheduled programming – and you anonymous? You have a fantastic day chillin’ behind other people’s names.

For the sake of my sanity, Twisted… how’s about you not approve the bullshit from here on – regardless of that whole freedom of speech thing, yeah? Be an elitist. Everybody’s doin’ it. 😛

THE BEST OF SL Magazine is a monthly publication which celebrates and honors those who have excelled in ANY field in Second Life.

CORRECTION: THE BEST OF SL Magazine is a monthly publication which celebrates the greatest ass-lickers + sycophants of SL, and honors those who have excelled in of the above in ANY field in Second Life. [Bearing in mind that sycophancy does in fact negate what field one is in and diminishes any form of credibility of the nominated individual or company that Madame Frolic Mills considers to be the Best (sic)].

Want to find out about the best of anything? Join this group; these people know it all, so feel free to ask away!

CORRECTION: Frolic’s mignons are as ill spirited and ignorant as he is so they are hardly authorities on anything other than regurgitating the biased bullshit he spins.
Purveyors of fine taste? [Well they might be authorities in scat!]

Btw, this is a chat group, and boy do we ever chat ! So if you don’t like to communicate this is not the group for you.

CORRECTION: This group is for social vagrants who have nothing better to do than gossip + spread morally bankrupt commentary on people who actually do fine work but refuse to join their likes and kiss Venezuelan or any Third World butt!

  5. Now, I’ll take a page from your book (not magazine) and comment from point-to-point.
    1. I copied and pasted directly from the description of The Best of SL group, which is public domain and therefore, not copyright infringement. Also, he has not secured a copyright on “The Best of SL”, so again, nada.

    2. True, but how many others are ejected from the group without a word? Compare that number to those who either blogged or disagreed with Frolic. It isn’t the first time that he has been called on such behavior.

    3. You know, just because I did not throw up a parentheses with “I am Bongo Oldbull, too”, does not mean that it’s a fact that I’ve hidden and anyone who has spoken with me in-world knows who I am. What does that have to do with anything, though? If I were talking about how he ripped her off, I could see where you would have grounds for calling be biased. However, did you actually read what I blogged? It was an interested issue that could potentially affect every designer on SL, so why shouldn’t I write about it?

    4. Wrong. Linden Labs never officially sanctioned the pageant, therefore Frolic’s project was never recognized as an actual sponsored affiliated pageant for LL. Do you believe everything that you hear? Despite what you may have heard on the grapevine, it is a clear case of copyright infringement.

    5. According to AP Press standards, when writing a piece based on opinion, “I think”, “I believe”, “perhaps” and “maybe” are acceptable, due to the simple fact that the article or in this case, MY BLOG, are not being included in circulated press. When Andy Rooney delivers a piece, it’s from his point-of-view.

Congrats on exercising your Freedom of Speech.

  6. Okay, if you’re going to comment, you should actually get your facts straight. Ignorance often gives the impression of stupidty, you know.

First of all, Babyhoney does not own or run the Aspire Model Management group on SL. That would be Kristianne Matfield and Benderoverand Hammerer. She was an employee, just like the models. So, whatever may or may not have happened with Aspire, it had nothing to do with Babyhoney and she is as affected by it as anyone else involved. She destroyed nothing and for the record, OUR sim is doing quite nicely, thanks. Anything involving Aspire should be taken up with either Kristianne or Ben, because as of the 17th, Babyhoney is no longer associated with the group in any capacity beyond a very good friendship.

And you do realize that I have blogged since this post? There’s other things that you could be commenting on, such as my keen fashion sense and ability to dress myself without help once in awhile. Ha. If your sole purpose is to try to get a rise out of me by bringing up Babyhoney, then you have fallen short of your goal by about a mile, as well as making yourself out to be an ass by not even knowing what you’re talking about. Have a good night, though, and try again when you have your facts checked and rechecked.

  7. Bringing Aspire in this discussion is just low, Aspire was dead in the water even before Kris and Ben tried to revive it. As one of the first SL fashion agencies was destined to die. As Ewing did too. So instead of side comments what else do you have ? Am I going to be under attack as well? You think that freedom of speech is a right ? I have news for you, it is not. Freedom of speech as stated by YOUR constitution is under heavy attack by Intellectual Properties activists. Instead of just babbling why don’t you DO something about that ? Oh? Are you feeling little and insignificant, that is your place you earned.

  8. You’re absolutely right. The issue I attempted to delve into had nothing to do with Aspire whatsoever and it sure as hell had nothing to do with Bho. I’ve started deleting asshole comments made to this post and this is the last comment that I’m going to be approving to it, because I’m really tired of reading ignorant, senseless attacks against her when she has nothing to do with this and doesn’t even want to be included in any discussion remotely related to Frolic. I wrote a blog on the effects of copyright infringement and a large case of it, but I did not write about Bho or Kris or Ben or anyone else. If people feel like the only way they can have an intellectual debate is to attack the woman I love and her friends, then I feel sorry for them.

I know what I know about Aspire from watching from the sidelines and over her shoulder. Regardless of whatever is happening there, it has nothing to do with my blog at all. If another person attacks Bho, I’m going to stop approving comments altogether.

  9. Oh and one last thing to Pete/Anabella, WordPress automatically logs IPs. An IP enables a person to trace the general location and owner of the comment. So, when I look at the comments made by Pete/Anabella and see that they have the same exact IP that traces back to Mexico, I think to myself, “So dumb.”

  10. Yes, I did delete your previous comment, because the fact remains that, at no point, have I included Babyhoney in any of this, because it has NOTHING TO DO WITH HER. The post was and is in reference to Frolic’s use of the Miss Universe title in his pageant and how that would affect the rest of Second Life. It was an example and happened to be a current event. If you really want to get technical, Premiere is also a RL trademarked company, as are just about every modeling agency on SL. What is your point with bringing her up repeatedly? Is that the best argument that Iyou have? Also, it was not until Frolic booted me from The Best of SL group that I even said anything negative about Frolic, in reference to the issue at hand. I did not include my personal thoughts on his character at all and still have not. You, however, seem to have some sort of grudge against Babyhoney and I that I cannot fathom, since I don’t have any clue who you even are.

Second of all, this is MY blog and not Babyhoney’s. I decide what comments I’m going to allow and quite frankly, this shit has gotten tired and no, I’m not going to continue to keep it going, because it’s ridiculous. I posted on an issue and all you can do is bitch and moan about someone who wasn’t even related to it, because obviously, you’re butthurt about some thing or another and can’t come up with a better argument than oh noez you wuz mean to me.

Third, I know that Frolic isn’t from Mexico and I never insinuated that he was. I flat out stated that your IP was the same as the other guy’s and that the IP originated in Mexico City. How can you possibly misconstrue everything that I say and keep wanting to come back for more? I have mellowed a great deal in the last year and have gotten better at curbing my temper, so it’s pointless for you to try to push my buttons.

You know what? Whatever helps you sleep better at night, kid? I don’t know you and after reading all this ridiculous shit that you’re spewing, I’m glad that I don’t know you. If you feel better about yourself by posting some hateful/non-factual blog against she and I, then go for it. I can tell you that she and I sleep just fine, no matter what.

Also, I will point out for the 30th time that Babyhoney never came up with the name for Aspire. The name was there before she was involved with it, seeing as the agency was bought and sold prior to her being hired on. We have had our sim for close to a year and a half, so that rips a hole in your little theory of her not lasting long anywhere. Thanks for playing, though and your parting gifts are waiting by the door.
